PAYMENT, CANCELLATION, AND REFUND POLICY – KARAKOLES 4X4
General note
All time periods established in this document are understood to be expressed in calendar days, unless otherwise required by mandatory law.
Purpose
This Policy governs the payment, cancellation, rescheduling, and refund conditions applicable to individual or group 4x4 camper vehicle rental services and other activities marketed by KARAKOLES 4X4.
Applicable regulations
Colombian Commercial Code, Law 300 of 1996, Law 1558 of 2012, Law 2068 of 2020, Law 1480 of 2011, and other applicable regulations.
Reservation and confirmation
The reservation will be considered confirmed only once the client has made the corresponding deposit payment and KARAKOLES 4X4 confirms availability.
Reservation deposit
To confirm the reservation, a deposit of the total value of the contracted service must be paid. Except as otherwise provided by law or in duly evidenced cases of force majeure, the deposit is non-refundable.
Balance payment – individual rental
The outstanding balance must be paid in full no later than fifteen (15) calendar days before the scheduled start date of the individual or group rental.
Failure to meet the payment deadline – group rental
If the client has not made full payment by thirty (30) calendar days before the rental, KARAKOLES 4X4 may unilaterally cancel the reservation, release the slot, and offer it to other clients. Payments made up to that date will not be refunded.
Security deposit
The security deposit must be paid in full no later than seven (7) calendar days before the departure date. The vehicle will not be handed over until the deposit specified by Karakoles 4x4 has been paid.
Cancellations of individual rentals
- More than 45 calendar days: refund of amounts paid, except the deposit.
- Between 44 and 16 calendar days: refund of 50% of payments made, except the deposit.
- 15 calendar days or less: no refund of payments, except the security deposit where applicable.
In all cases, the refund amount will be reduced by the fee charged by the payment gateway, if payment was made through that method.
No Show
Failure to show up will result in forfeiture of amounts paid, except the security deposit where applicable.
Rescheduling
Any rescheduling is subject to availability and the express acceptance of KARAKOLES 4X4.
Cancellation by KARAKOLES 4X4
KARAKOLES 4X4 may cancel or modify operations for reasons of safety, weather, public order, natural disasters, or force majeure. If, for any reason not attributable to THE LESSOR or Karakoles 4x4 — such as a delay by a previous LESSEE, an accident, a theft, a breakdown, or any other situation jeopardizing delivery of the previously reserved vehicle — it is not possible to proceed with delivery on the stipulated date and/or time, Karakoles 4x4 may provide THE LESSEE with a replacement vehicle if available, or a partial or full refund of the amount paid, without any additional compensation. Late pick-ups or early returns do not entitle THE LESSEE to any refund for the unused portion of the rental.
Refunds issued for any reason specified in this document will not include recognition of interest or any other additional amount.
POLÍTICA DE PAGOS, CANCELACIONES Y REEMBOLSOS – KARAKOLES 4X4
Nota general
Todos los plazos establecidos en este documento se entienden expresados en días calendario, salvo disposición legal imperativa en contrario.
Objeto
La presente Política regula las condiciones de pago, cancelación, reprogramación y reembolso aplicables a los servicios de alquiler de vehículos camper 4x4 individuales o en grupo y demás actividades comercializadas por KARAKOLES 4X4.
Normatividad aplicable
Código de Comercio Colombiano, Ley 300 de 1996, Ley 1558 de 2012, Ley 2068 de 2020, Ley 1480 de 2011 y demás normas aplicables.
Reserva y confirmación
La reserva se considerará confirmada únicamente cuando el cliente haya realizado el pago del anticipo correspondiente y KARAKOLES 4X4 confirme la disponibilidad.
Anticipo de reserva
Para confirmar la reserva se deberá pagar un anticipo del valor total del servicio contratado. Salvo disposición legal en contrario o casos de fuerza mayor debidamente acreditados, el anticipo no será reembolsable.
Pago del saldo – alquiler individual
El saldo pendiente deberá estar pagado en su totalidad a más tardar quince (15) días calendario antes de la fecha programada de inicio del alquiler individual o grupal.
Incumplimiento del plazo de pago – alquiler grupal
Si el cliente no ha efectuado el pago total hasta los treinta (30) días calendario anteriores al alquiler, KARAKOLES 4X4 podrá cancelar unilateralmente la reserva, liberar el cupo y ofrecerlo a otros clientes. Los pagos realizados hasta esa fecha no serán reembolsados.
Depósito de seguridad
El depósito de seguridad deberá encontrarse completamente pagado a más tardar siete (7) días calendario antes de la fecha de salida. No se entregará el vehículo hasta no estar pago el depósito indicado por Karakoles 4x4.
Cancelaciones de alquileres individuales
- Más de 45 días calendario: devolución de valores pagados, excepto anticipo.
- Entre 44 y 16 días calendario: devolución del 50% de los pagos realizados, excepto anticipo.
- Con 15 días calendario o menos: no habrá devolución de pagos, salvo el depósito de seguridad cuando corresponda.
En cualquier caso, al valor de devolución se le deduce la comisión cobrada por la pasarela de pagos en caso de haber realizado el pago por este medio.
No Show
La no presentación dará lugar a la pérdida de los valores pagados, salvo el depósito de seguridad cuando aplique.
Reprogramaciones
Toda reprogramación estará sujeta a disponibilidad y aceptación expresa de KARAKOLES 4X4.
Cancelación por KARAKOLES 4X4
KARAKOLES 4X4 podrá cancelar o modificar operaciones por razones de seguridad, clima, orden público, desastres naturales o fuerza mayor. Si, por cualquier motivo que no sea responsabilidad de EL ARRENDADOR o de Karakoles 4x4, como un retraso de EL ARRENDATARIO anterior, un accidente, un robo, una avería o cualquier otra situación que ponga en juego la entrega del vehículo previamente reservado y no fuere posible proceder con la entrega en la fecha y/o hora estipuladas, Karakoles 4x4 puede proporcionar a EL ARRENDATARIO un vehículo de reemplazo si estuviere disponible, o un reembolso parcial o total del monto pagado sin ningún tipo de compensación adicional. Las recogidas tardías o las devoluciones tempranas no dan derecho a EL ARRENDATARIO a ningún reembolso de la parte no utilizada del alquiler.
Las devoluciones de dinero por cualquier motivo especificado en este documento, no implicarán reconocimiento de intereses o ningún otro concepto
